1. Organizer
This raffle is organized by Postando GmbH, Bertramstrasse 2a, 60320 Frankfurt am Main, managing director: Mr. Johannes Duttenhöfer (hereinafter referred to as “organizer”).
2. Conditions of participation
2.1 Participation in the raffle is free of charge.
2.2 Participation in the raffle is possible exclusively under the conditions of participation stated here. By participating in the raffle, the participant expressly accepts these conditions of participation.
2.3 Participation in this raffle requires the conclusion of a contract between the participant and the organizer.
2.4 The contract is concluded as follows: the participant can register for the raffle by simultaneously granting his advertising & participation permission (by placing a check mark next to the corresponding declaration). In this case, by pressing the participation button, the player applies for the conclusion of a raffle contract, in which the service of the organizer is the provision of a chance to win prizes, as well as the execution of the lottery. In return, the participant is required to give his/her consent to advertising. In addition to the granting of the consent to advertising, the participant is also required to provide his/her e-mail address and telephone number in order to complete the registration process and to ensure that contact can be established in case of a drawing in the lottery.
2.5 The registration of the game participant will be considered an offer by the game participant. The organizer accepts the offer by including the player in the participant database. The player waives the right to receive the declaration of acceptance.
3. Eligible participants
3.1 All persons who have reached the age of 18 at the time of their participation are eligible to participate.
3.2 Employees, agents, legal successors and representatives of the Organiser as well as all advertising agencies and event companies involved in the event and the implementation of the raffle and their respective family and household members are excluded from participation.
3.3 Eligibility to participate does not exist or lapse if it transpires that the participant has not provided the necessary participation data (cf. 2.4 and 2.5) or if the participation data have been deliberately provided incorrectly.
3.4 Participants may only enter the competition in their own name. It is not permitted to play via straw men. Each participant may only participate once. Multiple entries will result in exclusion from the competition.
3.5 Participation in the lottery includes consent to the use of the first and last name on our social media platforms in the event of a win. Postings to the raffle may not contain any insults, false facts, competition, trademark or copyright infringements.
4. Exclusion from participation
Persons who do not have the right to participate or who violate the regulations mentioned in section 3 will be excluded from the competition. The organizer reserves the right to exclude other persons from participation, if an exclusion is objectively justified. A factual reason shall be deemed to exist in particular if a participant obstructs or disturbs the proper execution of the competition, e.g. by manipulating or attempting to manipulate the participation process, the game and/or the pages and/or violating the rules of the game and/or otherwise attempting to influence the competition in an unfair and/or dishonest manner.
5. Temporal framework of the raffle
5.1 The closing date for the draw is 08.01.2021. Registrations received after this date will not be entered into the prize draw.
5.2 The prize determination will take place within 4 weeks after the end of the raffle.
6. Determination of winnings
6.1 Prizes in kind and voucher codes will not be paid out in cash and are excluded from return.
6.2 The winners will be determined as follows: After the closing date, all participants’ names will be put into the lottery. The number the participant’s name will be in the lottery depends on the level achieved during the raffle. For example, a participant who reaches level 5 will be included 10 times in the lottery. That means the chances of winning a prize increase depending on the level. Then, for each prize, the winner will be determined by means of a computer-aided lottery. A participant has won if his name is drawn. Winning several prizes is possible and winning a prize does not exclude a participant from all following drawings in this raffle.The exact rewards and level conditions can be found on the raffle website itself.
6.3 A winner will be notified within four weeks of the prize determination via e-mail, post or telephone.
6.4 A prize claim is not transferable.
7. Forfeiture of the prize claim
If it is not possible to send a prize to the winner because notification and/or delivery of the prize has failed and cannot be made within 21 days of notification despite at least three different notification or transmission attempts, the claim to the prize will expire. The claim to the prize also lapses if the winner refuses to accept the prize. The same shall apply if it becomes apparent after the draw that a winner was excluded from participation or that the conditions for exclusion as set out in section 4 exist or were fulfilled.
8. Possibilities of termination
The organizer reserves the right to modify, cancel or terminate the competition for factual reasons at any time without prior notice. A factual reason shall be deemed to exist in particular if the raffle cannot (any longer) run according to plan, e.g. if computers are infected with viruses, if software or hardware errors occur or for any other technical, factual or legal reasons that impede the administration, security, integrity or the regular and proper execution of the competition. The organizer will decide at his reasonable discretion whether the competition can be continued in modified form or whether it should be terminated or terminated prematurely.
9. Additional clauses
9.1 If a provision of the Conditions of Participation is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
9.2 The competition is subject exclusively to the laws of the Federal Republic of Germany.
9.3 Legal recourse is excluded.
9.4 These terms and conditions of participation may be changed at any time by Postando GmbH without separate notification.
9.5 The organizer is not responsible for booking and organizing the trip (main prize of the competition). He only provides the trip as a voucher, but has no responsibility in the booking and planning of the trip. The trip is subject to the general conditions specified by our cooperation partners: The trip can generally be redeemed in the period between March 1, 2021 and October 31, 2022. Explicitly excluded is the period between December 24, 2021 and April 30, 2022, as well as vacation season/high season at the destination, depending on availability in the respective booking class (Freiklasse economy class, intended departure: Germany). All prizes are excluded from refund and are not transferable.
